This Privacy Policy is applicable to You.trend services (hereinafter - the “Platform”), including its app, website, software and related services (the “Services”). The Platform is under control of YOU.TREND INC. (hereinafter also referred to as «we», «our», «us»), where we respect, protect, and deeply care about privacy. This Privacy Policy provides an overview of our privacy practices, including the collection, processing, and protection of personal information, as well as information on how to control data collection and contact us.

Please read this Privacy Policy carefully to understand our practices regarding your personal data before using the Platform. To access or utilize our platform, your acceptance of the terms within this Privacy Policy is required.

This Platform is not intended for the use of children who are under 16 years old. Consequently, we do not intentionally collect, use, share or process the personal information of users who are under 16 years old. Users who are below the age of 18 can only access the Services with the authorization of their parent or legal guardian. We may also provide you with additional notice, namely by adding a statement to our Platform or providing you with an in-app notification.

INFORMATION WE COLLECT

There are three main categories of information we may collect: (a) information that you directly provide to us, including information that we obtain when you use our Services; (b) information that is collected automatically; (c) information that we receive from third-party sources.

Information that you directly provide to us means any data that you furnish us with when engaging with our Services and utilizing the Platform, namely:

1. Account and Profile information, including your name, username, email, password, phone number, profile image and date of birth, social media profile information.

2. User Content, which includes videos, challenges, dares, text, comments, pictures, stickers, effects, hashtags, generic messages which are sent during the callouts to participate in challenges and the associated metadata.

3. Information you send us while communicating with our customer support.

4. Information you provide us while participating in challenges, surveys, research, promotions, marketing campaigns, events, or contests. Such information may include your gender, age, likeness, and preferences.

Please be aware that other users of the Platform may copy and save your videos and challenges outside of the Platform, therefore, you must exercise caution and refrain from sharing any content you do not wish to be saved or shared by others. We are not responsible for the information you choose to submit, post or upload. Information about you may also be visible on the Platform, even if you are not a registered user, as this can occur when users of the Platform create and publish information about you.

Information that is collected automatically includes any data which is collected simultaneously as you engage with the Platform. This information is intended to enhance your user experience. This includes details about your device, location, log information, network activity, unique device identifiers, browsing and search history (including the content you have viewed within the Platform), as well as information collected through Cookies and other Technologies.

1. Usage information, such as information about your activity on the Platform.

2. Content information, such as details about the content you create or provide on the Platform, along with the associated metadata.

3. Device information, namely information from and about the devices you use to access the Platform, including your IP address, model of your device, operating system version, time zone settings, advertising identifiers, network type, user agent, mobile carrier, device identifiers, screen resolution, app and file names and types, browser type, keyboards installed, language, battery level, audio settings and connected headphones, and information about your wireless and mobile network connections.

Upon creating an account, we will automatically assign a device ID and user ID to you. If you login from multiple devices, we may use this information, along with other data collected from the devices you use to access the Platform, to identify and associate your activity across devices.

4. Device Phonebook, if you permit us to do so, as our Platform revolves around sharing videos and daily challenges with friends.

5. Videos and images from your device for when you would like to upload content.

6. Location information, namely data about your approximate location, including location information based on your SIM card and/or IP address. With your permission, we may also collect information about your precise location using several methods, such as GPS, wireless networks, cell towers, Wi-Fi access points etc.

7. Cookies, and similar technologies such as web beacons, web storage, unique advertising identifiers, etc., which are used by us to analyze your activity on the Platform to improve your experience using the Platform. Please be advised that most web browsers are set to accept cookies by default. Nevertheless, you can remove or reject browser cookies through the settings on your browser or device. Keep in mind, though, that removing or rejecting cookies could adversely affect the availability and functionality of our Services.

Information that we receive from third-party sources include data we may collect from other users including any mentions of you in their User Content, third-party apps such as Google, Facebook, Apple in the cases in which you choose to signup or login to the Platform using these services, as well as other social media platforms such as Instagram, Snapchat, TikTok, Youtube, Facebook in the cases in which you share videos from the Platform to these services.

HOW WE USE YOUR INFORMATION

We utilize your information to deliver you high-quality services, optimize your experience on our Platform, administer and support its functionalities, and continuously enhance our services. The specific purposes for which we leverage your information include:

- To provide the Services, to maintain functionality of the Platform, to develop, improve, support, deliver, protect our Services, including to enforce our Terms of Service and other conditions and policies.

- To enhance your experience by providing you with the most relevant content specified to your interests.

- To communicate with you, including by providing surveys, supporting inquiries or notifying you about changes in our Terms of Service, Privacy Policy, or other conditions and policies.

- To monitor and analyze video, challenge and trends, as well as usage of the Platform.

- To fulfill the mission of the Platform, enabling you and others to connect and form communities through shared content, to suggest accounts that align with your interests, provide personalized content, facilitate interactions with other users, and foster a vibrant social environment.

- To verify your identity and prevent any unauthorized or illegal activity.

- To maintain safety and security of the Platform, including by analyzing and reviewing User Content, messages and associated metadata for violations of our Terms of Service, or other conditions and policies.

- To detect any illegal activity on Platform, including fraud, abuse, violence or any other prohibited acts.

- To promote our Platform including by using User Content.

- To comply with legal requirements such as cooperating with legal authorities.

HOW WE SHARE YOUR INFORMATION

We do not sell your personal information.

1. With other users of the Platform, as well as with the general public. We may share your username and your profile picture; information about your interaction with our Services, such as the usernames and number of users with whom you are friends with on the Platform, videos and challenges that you have uploaded on the Platform, as well as other contents you post.

- With our service providers who perform services on our behalf (including, non-personal, aggregated or de-identified information).

- For legal, safety, and security purposes, such as to comply with a legal process, government request or inquiry, applicable law, rule, or regulation; to defend any legal claim; to enforce any terms applicable to the Platform; to protect the rights and safety of the users of the Platform and of the Platform itself; to detect and resolve any security or legal concerns.

3. As a part of a sale, merger, acquisition or other business transfer.

4. With your consent. We may share some of your data for other purposes based on your consent. For instance, we use third-party services, such as Facebook, Google and Apple to offer you quick and convenient methods to sign up and log in, as well as with Instagram, TikTok, Snapchat, Facebook and YouTube to provide you with the ability to seamlessly upload your content to other social media platforms. In the cases you choose to use these features, we may share information about you with these third-party services. This information may include your Platform account information, information about your activity on the Platform, and additional information.

HOW YOU CONTROL YOUR PERSONAL DATA

It is important to us that you possess a comprehensive understanding of your data protection rights. Every user of our Platform is entitled to the following:

Right to Know, Access, Rectification & Portability: you have the ability to update general account information on the Platform. You have the right to request access to your personal information and obtain a copy of it in a readily accessible format, along with an explanation of how that information is utilized. Please be aware that we may request identity verification or additional details prior to granting access or allowing updates to your personal information, to ensure the security of your data and prevent unauthorized requests. Additionally, if any of your personal data processed by us is inaccurate or incorrect, you have the right to request rectification.

Right to Deletion: You have the ability to delete the content you have posted on the Platform, such as some information from your account. You also have the ability to delete your account, though we hope you will remain with us.

Right to Withdraw Consent: where we rely on consent, you can choose to withdraw your consent to our processing of your information, after which the processing shall be stopped. Please be advised that this may lead to changes in the functionality of the Services.

HOW WE KEEP YOUR PERSONAL DATA

The security of your personal information is imperative to us. We prioritize the protection of your personal information with the same level of care and attention as we do for our own confidential data. To safeguard your information, we store it on secure cloud servers and employ encryption techniques to deter unauthorized access. Additionally, we leverage the capabilities of Cloudflare to counter malicious activities such as DDoS attacks, malicious bots, and other unauthorized intrusions on the Platform. In the event of a personal information breach, we adhere to widely accepted industry standards to address the situation promptly. As mandated by law, we will promptly notify you and any relevant regulatory authorities of any such breach when legally required to do so.

While we are dedicated to safeguarding your privacy and data, it is important to acknowledge that no method of transmission over the Internet or electronic storage can provide absolute security. Therefore, we cannot guarantee the complete security of any information you transmit to us, nor can we ensure that your information will not be accessed, disclosed, altered, or destroyed due to breaches of our industry-standard physical, technical, or managerial safeguards.

HOW LONG WE KEEP YOUR PERSONAL DATA

We will store your personal data as long as it is necessary to do so in order to fulfill the purposes for which it was originally collected as described above, after which it will be deleted or archived except to the extent that it is necessary for the purposes of satisfying any legal obligations to which we are subject or for another legitimate and lawful purpose.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether it can achieve those purposes through other means, and the applicable legal requirements.

For instance, when we process your account information, we keep this information for as long as you are a user of the Platform. If you violate our Terms of Service, or other conditions or policies, we may delete your profile, but we may keep other information about you to process with the violation.

We store and process your data on secure servers within the territory of the United States.

CHILDREN AND TEENAGERS

The privacy of children and teenagers is extremely important to us.

Our Platform is designed for individuals over the age of 16, and it is not directed to the individuals under this age. As a result, we do not intentionally collect personal information from anyone under the age of 16.

In the event that we discover that personal information has been gathered from a child on the Platform, we will remove the information and deactivate the child's account.
